Terms of Service

Article 1 - Parties

This User Agreement ("Agreement") is executed between:

Qeople Yazılım ve Medya A.Ş. ("Mahal Media"), located at Muradiye Mah. Celal Bayar University Campus, Küme Evler Tekno Kent No: 22, Yunusemre/Manisa, Turkey

and

Natural and legal persons who create a User Profile through the Mahal Media Mobile Application, under the terms set forth below.

Article 2 - Definitions

Article 3 - Subject and Scope

3.1. The subject of this agreement is to determine the conditions for benefiting from the services available in the application and to be offered by Mahal Media in the future, and the rights and obligations of the Parties.

3.2. By accepting the terms of this Agreement, the User also accepts all statements made by Mahal Media regarding the use and services within the Application. The User accepts, declares, and undertakes to act in accordance with all matters specified in the said statements.

Article 4 - Membership and Usage Conditions

4.1. This provision includes the membership conditions and rights and obligations of Users who create a profile in the Application.

4.2. The User cannot force Mahal Media to provide Service within the Application by claiming to have fulfilled the Membership Conditions completely. Mahal Media reserves the right not to allow the User access to the Application even if there are no deficiencies or errors in the User's Membership Conditions.

4.3. Mahal Media assigns a code to the device on which the User downloads the Application. The User accepts, declares, and undertakes that they are solely responsible for the security, theft, and unauthorized use of their access information.

4.4. The User is obliged to use an appropriate information system for the functionality of the Application.

4.5. Mahal Media may provide information, send reminders and electronic messages through the User's contact information registered in the Application or directly through the Application.

4.6. Mahal Media is not a party to transactions performed by the User with other third parties through the Application and does not assume any commitment or responsibility related to these transactions.

Article 5 - Application Usage Terms

5.1. Applications made through minors or persons not authorized to represent and bind legal entities cannot benefit from the rights arising from being a User, even if they have completed the registration process.

User Obligations

The User agrees to comply with the following rules while using the Application:

• Act in accordance with laws and general moral principles
• Not violate the rights of third parties
• Provide accurate and up-to-date information
• Protect account security
• Not share spam or harmful content
• Not attempt to disrupt the operation of the Application

Article 6 - Responsibilities and Limitations

6.1. The User accepts to act in accordance with all applicable legislation while using the Application.

6.2. All legal and criminal responsibility arising from the content shared by the User belongs to the User.

6.3. Mahal Media cannot be held responsible for interactions between Users and damages arising from these interactions.

6.4. Mahal Media is not responsible for disruptions that may occur due to technical failures, interruptions, or force majeure.

Article 7 - Intellectual Property Rights

7.1. Mahal Media is the owner or licensee of the intellectual and industrial property rights of the general appearance and design of the Application and Website, as well as all information, images, trademarks, domain names, logos, icons, software, technical data, and materials contained in the Application and Website.

7.2. No material on the Application and Website may be:

• Modified, copied, reproduced without prior permission
• Converted to another license
• Republished
• Uploaded to another computer
• Transmitted or distributed

7.3. The rights to the software used in the design and database creation of these pages belong to Mahal Media. Reverse engineering is strictly prohibited.

Article 8 - Termination

8.1. The User who causes any damage to Mahal Media and third parties as a result of acting contrary to the provisions of this Agreement is responsible for such damage.

8.2. If Mahal Media determines that the Agreement has been violated, it may immediately terminate this Agreement unilaterally without prejudice to its claim rights arising from this Agreement.

8.3. The Parties may terminate this Agreement at any time. If the User deletes their profile in the Application, they shall be deemed to have terminated this Agreement.

8.4. This Agreement will remain in effect as long as the Application continues to be used and a new agreement is not offered to Users by Mahal Media.

Article 9 - Applicable Law and Jurisdiction

9.1. This Agreement and any claims, disputes, or controversies arising from or related to this Agreement shall be interpreted according to and governed by the Laws of the Republic of Turkey.

9.2. Turkish Law shall apply exclusively in the resolution of disputes arising from this Agreement, and the Manisa Courts and Enforcement Offices shall have jurisdiction.

Article 10 - Effectiveness

10.1. The Services to be provided through the Application pursuant to this Agreement will be activated upon the User's touch of the approval button.

10.2. This User Agreement has entered into force on the date it was approved electronically by the Users.
